Terms and Conditions

Effective date: February 2026

By booking a service or hiring equipment through this website, you agree to the following terms and conditions.

1. Clinical services

  • Midwife Emely provides private midwifery services.

  • Suitability: some services require an assessment before booking or delivery. Midwife Emely reserves the right to decline a booking or recommend an alternative pathway if an assessment suggests the service is not safe or appropriate for your individual circumstances.

  • Informed consent: where relevant, you may be asked to sign a consent form before services are provided.

2. TENS machine hire

  • Hire period: standard hire period is 4 weeks, typically starting from 37 weeks' gestation.

  • Security deposit: a refundable deposit may be required and will be returned once the unit is received in full working order.

  • Late returns: a daily fee of $10 may apply for units not returned by the agreed date, as this impacts availability for others.

  • Condition: the unit must be returned with all original cables and instruction leaflet. Used electrode pads do not need to be returned.

3. Cancellations and refunds

  • Rescheduling and cancellations: we require at least 24 hours' notice for cancellations. Cancellations made with less than 24 hours' notice may incur a fee of 50% of the service cost.

  • Due to the nature of midwifery work, Midwife Emely may occasionally become unavailable — for example, due to attending a birth. In this situation you may be asked to reschedule. Where possible and with your consent, an alternative appointment with another suitably qualified practitioner may be offered.

  • Change of mind: change-of-mind refunds are not available once an appointment has commenced, or for TENS hire once the unit has been collected.

4. Professional boundaries

  • Midwife Emely operates as a private practitioner. Services provide support and education and do not replace care provided by your hospital team, GP, obstetrician, or other primary provider.

  • Emergencies: Midwife Emely does not provide emergency services. If urgent concerns arise, emergency services (000) will be contacted and/or you will be advised to seek urgent medical care immediately.

5. Limitation of liability

We provide services with due care and skill and in line with applicable professional standards. All health care involves some risks, which will be discussed with you as relevant during your appointment.

Nothing in these terms limits your rights under the Australian Consumer Law.
